Failure to deliver shoes pinches Amazon India

The Mohali District Consumer Disputes Redressal Forum has penalised Amazon India for not delivering a pair of shoes to its prime member in the stipulated time.

The forum ordered the management of Amazon to pay Rs 2,000 as compensation for mental agony and harassment and litigation expenses of Rs 2,000 to the complainant, Manoj Kumar, a resident of Mohali. The forum also ordered the company to refund an amount of Rs 499, which the complainant had paid to them (Amazon) to become its prime member, along with 6 per cent interest with effect from July 11, when the amount in question was paid, till the date of payment.

In his complaint to the forum, Manoj Kumar had stated that he had become Amazon’s prime member for a period of one year on July 11, 2017, by paying Rs 499 to the company (which gives extra benefits to such members). He stated that he had placed an online order for a pair of shoes on November 12, 2017. The complainant stated that he had contacted the opposite party and told it that he needed the shoes for a marriage and the company had promised to deliver the item to him as early as possible. Manoj Kumar stated that despite the assurance of the timely delivery of the item, his order was cancelled and he did not get the shoes. Manoj Kumar asked for a refund of Rs 499 as he did not want to remain the prime member, but the opposite party refunded Rs 200 as a token of apology, which was credited in the Amazon pay balance of the complainant.

Regarding the alleged undelivered product, the opposite party stated that the complainant was duly informed vide an email that during the last scanning of the product, it was found damaged due to which the product was unfit for delivery.

After hearing both parties, the forum ordered a refund with the compensation and litigation costs, which have to be made within 30 days from the date of the receipt of the order.


Also told to refund membership fee
